“Challenging a Candidate’s Eligibility:

Neither the municipal recorders nor the governing bodies have the authority to make judgments about whether a candidate meets the eligibility requirements. Sometimes an opposing candidate will attempt to pressure the filing officer to take someone off the ballot based on information that the person is not a resident or is not eligible for some other reason. Only the “party-switching” provision provides a mechanism for refusing certification. Otherwise, eligibility can be challenged in only two ways: (1) by a court (Circuit Court) proceeding seeking the candidate’s name be removed from the ballot before the election or afterward; or (2) by contesting the election (with Municipal Governing Body) if the candidate in question wins.”
