Public Notice regarding the update to the business license fees
PUBLIC NOTICE Please take notice that the Council of the Town following first reading on May 17, 2022, will take up for second reading and potential final adoption of Ordinance 2022-05-17-1 and Ordinance 2022-05-17-2. The purpose of Ordinance 2022-05-17-1 is to amend Chapter 18, Article II, Division 2, of the Town of Bath Code to repeal Section 18-57, which sets out the schedule of license fees to be paid to conduct business in the Town of Bath depending upon the type of business being conducted. Ordinance 2022-05-17-1 replaces the schedule of fees with a general business license fee of $20 per fiscal year (the Town fiscal year runs from July 1 – June 30), plus any applicable additional filing fees, license fees, or service fees. The purpose of Ordinance 2022-05-17-2 is to amend Chapter 6, Articles II-IV of the Town of Bath Code to repeal Sections 6-28, 6-29, 6-60, 6-61, 6-89, and 6-90, which set the licenses and fees required for the sale of wine, liquor, beer in the Town of Bath. Ordinance 2022-05-17-2 replaces Section 6-28 and sets wine license fees as follows: (1) distributor’s license, $2,500 per fiscal year; (2) retailer’s license, $150 per fiscal year; (3) wine specialty shop license, $250 per fiscal year; (4) wine tasting license, $150 per fiscal year; (5) private restaurant serving wine only, $250; (6) private restaurant serving wine and non-intoxicating beer only, $400. Ordinance 2022-05-17-2 replaces Section 6-29 and sets the liquor license fees as follows: (1) retail liquor sales (class A/class B), $1,500. Ordinance 2022-05-17-2 replaces Sections 6-60 and 6-61 and sets beer license fees as follows: (1) retail beer sales (class A/class B), $150; (2) distributor, $1,000; (3) brewery producing 12,500 barrels or less, $500; (4) brewery producing 12,500 barrels or more, $1,000; (5) tavern serving non-intoxicating beer only, $150. Ordinance 2022-05-17-2 replaces Section 6-90 and sets license fees for the following establishments as follows: (1) private club of less than 1,000 members, $750; (2) private club of more than 1,000 members, $1,250; (3) fraternal or veterans organizations, nonprofit social clubs, $500. These Ordinances will be taken up for final adoption by the Bath Town Council at its regularly scheduled meeting on June 7, 2022, at 5:30 p.m. at the Town of Bath Municipal Center in the Bath Council Chambers. Copies of the Ordinance are available at the Town of Bath Municipal Center Office, 271 Wilkes Street, Berkeley Springs, WV 25411. The proposed Ordinances may be inspected by the public at the Town of Bath Municipal Center. A reasonable number of copies of the proposed Ordinance will be kept at the Bath Municipal Center to be made available for public inspection.
